FILLMORE CITY ORDINANCE NO. 26-03 AN ORDINANCE AMENDING FILLMORE CITY MUNICIPAL CODE § 9.1.1 TO ADOPT THE UTAH WILDLAND URBAN INTERFACE CODE The City Council of the City of Fillmore, Utah, (referred to herein as the “City Council”), states the following as the basis for enacting this ordinance: RECITALS A. WHEREAS, Utah Code § 15A-2-103 authorizes a local compliance agency to adopt the Utah Wildland Urban Interface Code as a local amendment to the State Construction Code; and B. WHEREAS, the Fillmore City Planning Commission has recommended adoption of the International Wildland-Urban Interface Code into Fillmore City Municipal Code § 9.1.1; and C. WHEREAS, the City Council finds that adopting the applicable Utah Wildland Urban Interface Code will promote life safety and property protection in designated wildlandurban interface areas within Fillmore City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF FILLMORE CITY, UTAH: SECTION 1: Amendment to the Fillmore City Municipal Code, Title 9, Chapter 1. Fillmore City Municipal Code § 9.1.1, Codes Adopted, is amended by adding the following provision: I. Utah Wildland Urban Interface Code. The 2006 edition of the Utah Wildland Urban Interface Code, issued by the International Code Council, together with the alternatives or amendments approved by the Utah Division of Forestry, Fire, and State Lands, is adopted by reference as a local amendment to the State Construction Code, as authorized by Utah Code § 15A-2-103(2). A copy of the adopted code shall be maintained for public examination in the office of the City Recorder. SECTION 2: Scope and administration. The code adopted by this ordinance applies to construction regulated by the State Construction Code within wildland-urban interface areas designated by the City. Before applying the code to a particular area, the City shall identify the applicable wildland-urban interface area through an official City map or other City designation adopted in accordance with applicable law. The City may adopt additional implementing standards, maps, and procedures consistent with this ordinance, the State Construction Code, and applicable state law. SECTION 3: Codification. The City Recorder shall file a copy of the code adopted by reference for public use and examination before this ordinance is adopted. The City Recorder is authorized to make non-substantive formatting, numbering, and cross-reference corrections necessary to incorporate this ordinance into the Fillmore City Municipal Code. SECTION 4: Publication and effective date. The City Recorder shall deposit a copy of this ordinance in the office of the City Recorder and publish a short summary of this ordinance as a Class A notice, as required by Utah Code § 10-3-711. This ordinance takes effect upon completion of those requirements. SECTION 5: Severability. If any provision of this ordinance is held invalid, that invalidity does not affect any other provision that can be given effect without the invalid provision. SECTION 6: Conflicting Ordinances. To the extent that any ordinances, resolutions, or policies of Fillmore City conflict with the provisions of this ordinance, they are hereby amended to be in accordance with the provisions hereof. SECTION 7: Adoption of Recitals. The Recitals set forth above are hereby adopted and incorporated into this ordinance by reference. PASSED AND ADOPTED this _ day of ___ 2026.
